SENATE AMENDMENT 1, TO 2005 ASSEMBLY BILL 523

AB523-SA1,1,1 At the locations indicated, amend the bill as follows:

AB523-SA1,1,5 1. Page 1, line 3: after "forces" insert ", the minimum age for hunting and possessing a firearm, age specific restrictions on hunting and on possessing a firearm while hunting, requirements for obtaining a hunting certificate of accomplishment, and establishing a hunting mentorship program".

AB523-SA1,1,6 2. Page 1, line 4: delete " Section 1" and substitute "Section 1d".

AB523-SA1,1,7 3. Page 1, line 4: before that line insert:

AB523-SA1,1,8 " Section 1b. 29.184 (1) (b) of the statutes is amended to read:

AB523-SA1,1,10 29.184 (1) (b) "Minor" means a person who is at least 12 10 years of age but under 18 years of age.

AB523-SA1, s. 1c Section 1c. 29.184 (6) (b) 1. of the statutes is amended to read:

AB523-SA1,1,12 29.184 (6) (b) 1. The applicant is at least 12 10 years old.".

AB523-SA1, s. 2c Section 2c. 29.304 (1) (ag) of the statutes is created to read:

AB523-SA1,2,11 29.304 (1) (ag) Restrictions on possession or control of a firearm by persons under the age of 10. No person under 10 years of age may have in his or her possession or control any firearm unless he or she is enrolled in the course of instruction under the hunter education program and is carrying the firearm in a case and unloaded to or from that class under the supervision of his or her parent or guardian, or a person at least 18 years of age who is designated by the parent or guardian, or is handling or operating the firearm during that class under the supervision of an instructor.

AB523-SA1, s. 2d Section 2d. 29.304 (1) (am) of the statutes is created to read:

AB523-SA1,2,15 29.304 (1) (am) Restrictions on hunting by persons 10 or 11 years of age. No person who is 10 or 11 years of age may hunt unless he or she is hunting with a mentor and meets the requirements under s. 29.592.

AB523-SA1, s. 2e Section 2e. 29.304 (1) (b) of the statutes is renumbered 29.304 (1) (b) (intro.) and amended to read:

AB523-SA1,2,20 29.304 (1) (b) Restrictions on possession or control of a firearm by persons 10 or 11 years of age. (intro.) No person under 12 who is 10 or 11 years of age may have in his or her possession or control any firearm unless he any of the following apply:

AB523-SA1,2,25 1. He or she is enrolled in the course of instruction under the hunter education program and he or she is carrying the firearm in a case and unloaded to or from that class under the supervision of a his or her parent or guardian, or by a person at least 18 years of age who is designated by the parent or guardian, or is handling or operating the firearm during that class under the supervision of an instructor.

AB523-SA1,3,3 29.304 (1) (b) 2. He or she is hunting with a mentor and meets the requirements specified under s. 29.592.

AB523-SA1, s. 2g Section 2g. 29.304 (1) (c) of the statutes is amended to read:

AB523-SA1,3,7 29.304 (1) (c) Restrictions on obtaining hunting approval. Except as provided under par. (d), no person under 12 10 years of age may obtain any approval authorizing hunting.

AB523-SA1, s. 2h Section 2h. 29.304 (1) (d) of the statutes is amended to read:

AB523-SA1,3,12 29.304 (1) (d) Restrictions on validity of certificate of accomplishment. A person under 12 10 years of age may obtain a certificate of accomplishment if he or she complies with the requirements of s. 29.591 (4) but that certificate is not valid for the hunting of small game until that person becomes 12 10 years of age.

AB523-SA1, s. 2j Section 2j. 29.304 (2) (title) of the statutes is amended to read:

AB523-SA1,3,14 29.304 (2) (title) Persons 12 to 14 and 13 years of age.

AB523-SA1, s. 2k Section 2k. 29.304 (2) (a) of the statutes is amended to read:

AB523-SA1,3,20 29.304 (2) (a) Restrictions on hunting. No person 12 years of age or older but under 14 years of age may hunt unless he or she is accompanied by a his or her parent or guardian, or by a person at least 18 years of age who is designated by the parent or guardian, or he or she is hunting with a mentor and meets the requirements specified under s. 29.592.

AB523-SA1,5,3 29.304 (3) (a) 3. He or she is hunting with a mentor and meets the requirements specified under s. 29.592.

AB523-SA1, s. 2nj Section 2nj. 29.304 (3) (b) (intro.) of the statutes is amended to read:

AB523-SA1,5,23 29.304 (3) (b) 4. He or she is hunting with a mentor and meets the requirements specified under s. 29.592.

AB523-SA1, s. 2p Section 2p. 29.304 (5) of the statutes is amended to read:

AB523-SA1,6,4 29.304 (5) Exception. Notwithstanding subs. (1) to (3), a person 12 years of age or older may possess or control a firearm and may hunt with a firearm or, bow and arrow, or crossbow on land under the ownership of the person or the person's family if no license is required and if the firing of firearms is permitted on that land.

AB523-SA1, s. 2pb Section 2pb. 29.304 (5) (b) of the statutes is created to read:

AB523-SA1,6,9 29.304 (5) (b) The restrictions on the possession and control of a firearm under sub. (1) do not apply to a person using a firearm in target practice if he or she is accompanied by his or her parent or guardian or by a person at least 18 years of age who is designated by the parent or guardian.

AB523-SA1, s. 2pc Section 2pc. 29.563 (2) (a) 4. of the statutes, as affected by 2005 Wisconsin Act 25, is amended to read:

AB523-SA1,6,13 29.563 (2) (a) 4. Small game issued to 12-year-olds 10-year-olds to 17-year-olds: $6.25.

AB523-SA1, s. 2pd Section 2pd. 29.563 (2) (a) 5g. of the statutes, as created by 2005 Wisconsin Act 25, is amended to read:

AB523-SA1,6,17 29.563 (2) (a) 5g. Deer issued to 12-year-olds 10-year-olds to 17-year-olds: $17.25.

AB523-SA1, s. 2pe Section 2pe. 29.563 (2) (a) 8m. of the statutes, as created by 2005 Wisconsin Act 25, is amended to read:

AB523-SA1,6,21 29.563 (2) (a) 8m. Archer issued to 12-year-olds 10-year-olds to 17-year olds: $17.25.

AB523-SA1, s. 2pf Section 2pf. 29.563 (2m) of the statutes, as created by 2005 Wisconsin Act 55, is amended to read:

AB523-SA1,7,2 29.563 (2m) Hunting approvals for certain nonresidents. The fees for hunting approvals for a 12 10- to 17 year-old 17-year-old who is not a resident and who exhibits proof that his or her parent is a resident shall be the same as the fees for hunting approvals for residents under sub. (2) (a) and (c).

AB523-SA1, s. 2pg Section 2pg. 29.563 (4) (a) 1m. of the statutes, as affected by 2005 Wisconsin Act 25, is amended to read:

AB523-SA1,7,6 29.563 (4) (a) 1m. Sports issued to 12-year-olds 10-year-olds to 17-year-olds: $32.25 or a greater amount at the applicant's option.

AB523-SA1, s. 2ph Section 2ph. 29.563 (4) (a) 2m. of the statutes, as affected by 2005 Wisconsin Act 25, is amended to read:

AB523-SA1,7,10 29.563 (4) (a) 2m. Conservation patron issued to 12-year-olds 10-year-olds to 17-year-olds: $70.25 or a greater amount at the applicant's option.

AB523-SA1, s. 2pj Section 2pj. 29.563 (4) (b) 1m. of the statutes is amended to read:

AB523-SA1,7,13 29.563 (4) (b) 1m. Sports issued to 12-year-olds 10-year-olds to 17-year-olds: $33.25 or a greater amount at the applicant's option.

AB523-SA1, s. 2pk Section 2pk. 29.563 (4) (b) 2m. of the statutes is amended to read:

AB523-SA1,7,16 29.563 (4) (b) 2m. Conservation patron issued to 12-year-olds 10-year-olds to 17-year-olds: $72.25 or a greater amount at the applicant's option.

AB523-SA1, s. 2pm Section 2pm. 29.592 of the statutes is created to read:

AB523-SA1,7,21 29.592 Hunting mentorship program. (1) Except as provided in sub. (3), a person who is at least 10 years old may hunt in this state without obtaining a certificate of accomplishment under s. 29.591 and may, while hunting, possess or control a firearm if all of the following apply:

AB523-SA1,7,23 (a) At all times when hunting, the person is within arm's reach of a mentor who meets the qualifications under sub. (2).

AB523-SA1,7,24 (b) The person holds a hunting approval.

AB523-SA1,8,2 (2) No person may serve as a qualified mentor for a hunter unless the person meets all of the following requirements:

AB523-SA1,8,3 (a) The person is 18 years of age or older.
